Welcome to Buttah Babies Bodywork! These Terms of Service ("Terms") govern your use of our website located at www.buttahbabies.com (the "Site") and any related services provided by Buttah Babies Bodywork ("we," "us," "our").

This website is operated by Buttah Babies Bodywork, a corporation incorporated under the laws of the Commonwealth of Puerto Rico. Throughout the site, the terms “we”, “us” and “our” refer to Buttah Babies Bodywork. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

2. Products and Services

We specialize in skincare products, including our signature hand-whipped shea butters.

Product Information: We strive to be as accurate as possible in the descriptions of our products. However, we do not warrant that product descriptions or other content is completely accurate, reliable, or error-free. Due to the natural ingredients used, variations in color, scent, and texture may occur between batches.
Skincare Disclaimer: Our products are for external use only. We recommend performing a patch test on a small area of skin before full application. Discontinue use if irritation occurs. The information on our Site is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Our products are not intended to diagnose, treat, cure, or prevent any disease. Consult with a healthcare professional for any health concerns.
Modifications: We reserve the right to modify or discontinue products or services without notice at any time. Prices for our products are subject to change without notice.

3. Shipping and Fulfillment

Our products are shipped from two different locations. Please take note of the following:

Buttah Babies Hand Whipped Shea Butters: These specific products are personally curated and shipped directly from our location in Washington D.C.
All Other Skincare Products: All other products available on our Site are fulfilled and shipped by our third-party partner, Blankabrand, from their facilities in North America.

Important Shipping Considerations:

Separate Shipments: If you order both a Hand Whipped Shea Butter and another product fulfilled by Blankabrand, you will receive your items in separate packages and potentially at different times.
Processing Times: Processing times may vary. We will provide estimates, but cannot guarantee specific delivery dates.
Shipping Address: You are responsible for providing a complete and accurate shipping address. We are not liable for packages lost or returned due to an incorrect or incomplete address provided by you.
Risk of Loss: All items purchased from us are made pursuant to a shipment contract. This means the risk of loss and title for such items pass to you upon our delivery to the carrier.

4. Payments

We use a third-party payment processor to bill you through a payment account linked to your account on the Site. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms. We are not responsible for errors by the Payment Processor. By choosing to purchase, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for your purchase in accordance with the applicable payment terms.

5. Returns and Refunds

Due to the personal nature of our skincare products, all sales are final. We do not accept returns or exchanges.

However, if your product arrives damaged or you received the incorrect item, please contact us within 7 days of receiving your order at breathe@buttahbabies.com. Please include your order number and a photo of the damaged or incorrect item. We will review your claim at our sole discretion, may offer a replacement or store credit.

6. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, audio clips, and software, is the property of Buttah Babies Bodywork or its content suppliers and is protected by United States and international copyright laws. The name "Buttah Babies Bodywork" and our logos are trademarks and may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Buttah Babies Bodywork.

7. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

In no case shall Buttah Babies Bodywork, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

You agree to indemnify, defend and hold harmless Buttah Babies Bodywork and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

11. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Commonwealth of Puerto Rico, without regard to its conflict of law provisions.

You agree that any legal action or proceeding between you and Buttah Babies Bodywork shall be brought exclusively in the state or federal courts located in San Juan, Puerto Rico.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
